Whistleblowing Procedure

Italian Legislative Decree no. 24 of 10 March 2023, transposes into our legal system Directive (EU) 2019/1937, concerning the protection of persons who report breaches of national or Union law, the so-called Whistleblowing Directive, of which they have become aware in a public or private work context.
The purpose of the Directive is to regulate the protection of whistleblowers within the European Union, through minimum standards of protection aimed at standardizing national regulations.
Italian Legislative Decree 24/2023, repealing the previous provisions relating to whistleblowing, intends to strengthen the principles of transparency and responsibility regarding reporting, as well as preventing the commission of crimes, by collecting in a single regulatory text the entire legal framework of reporting channels and the protections granted to whistleblowers, both in the public and private sectors.
The aforementioned decree recognises that whistleblowing plays a key role in the prevention of regulatory breaches and ensures that whistleblowers of public and private companies enjoy a more structured protection in order to encourage whistleblowing and combat illegality.
The legislator, in addition, to guarantee the internal reporting channels and their correct application, has also established an external reporting channel, whose management is entrusted to the National Anti-Corruption Authority, an entity also responsible for imposing pecuniary administrative sanctions on organizations in different circumstances, including the event of failure to prepare internal reporting channels or failure to adopt procedures for the implementation and management of reports.
CONSERVE ITALIA constantly implements strategies aimed at preventing illegality and, therefore, has implemented the principles and requirements contained in the aforementioned Legislative Decree 24/2023.
